Nolan is due to stand trial next month for allegedly speeding at 65mph in a Land Rover on the A188, Benton Lane, Newcastle, on May 1.
Judge Earl: “Kevin Anthony Nolan admitted to being the driver, so I don’t see how identification is an issue, perhaps he didn’t know he was the driver.
“Since they are not here, I am going to ask them to particularise. Are they saying it was not him?
“We know it is the right vehicle; it has appeared in a lot of press recently because of his houseguest.
“Since I do go and watch them, it may seem biased if I was to try the case.”
If the court fails to find another judge, the case may have to be postponed until the New Year.
