The Newcastle midfielderseemed to punch Maloney during the Magpies' 4-1 at Villa Park, but the FA say the television pictures are "inconclusive".
Referee Lee Mason did not see the incident but on reviewing the footage says he got it right on the day, and it did not warrant a red card.
The issue has been dropped.
